By using this Website you indicate that you have read and accepted these Terms of Use and that you agree to be bound, without limitation or qualification, by them, as well as our Privacy Policy which is incorporated herein by reference. We may update these Terms of Use from time to time. Any changes will be notified to you via a suitable announcement on the Website. 1. The Website is operated by Vetstoria Limited, a company registered in England and Wales under company number 5896625 whose registered office is at Matrix House, 12-16 Lionel Road, Canvey Island, Essex, England, SS8 9DE (“Vetstoria”, “we” or “us”). 

2. Access to the Website is permitted on a temporary basis and Vetstoria reserves the right to withdraw or amend the service provided on the Website without notice. Vetstoria shall not be liable if for any reason the Website is not available at any time or for any period. From time to time, Vetstoria may restrict access to some parts of the Website, or the entire Website, if required. Vetstoria aims to update the Website regularly and may change the content at any time. Vetstoria may, therefore, have to suspend access to the Website or close it if necessary. 

3. You are responsible for making all arrangements necessary for you to have access to the Website and for ensuring that all persons who access the Website through your internet connection are aware of these Terms of Use and that they comply with them. In order to use the Website properly, users must have the necessary hardware, software and reliable internet access, none of which is the responsibility of Vetstoria and is the entire responsibility of the user.

Vetstoria operates the Website in line with these Terms of Use.

Any of the material on the Website may be out of date or inaccurate at any given time and Vetstoria is under no obligation to update such material, although we will use reasonable efforts to do so. Vetstoria assumes no liability or responsibility as to the accuracy, reliability or completeness of any information on this Website.

Vetstoria does not verify the accuracy or truth or completeness of, and shall not be liable for and accepts no responsibility for, any information presented on the Website including, but not limited to, liability in connection with any connections made directly with a third party, or any circumstances that may arise from your use of the Website.

8. Vetstoria cannot guarantee that the Website is free from infection by viruses or anything else that has contaminating or destructive properties. You must not misuse the Website by introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorized access to the Website, the server on which the Website is stored or any server, computer or database connected to the Website.

No advice given; no veterinary/patient relationship created

9. Vetstoria shall not be held liable in any way whatsoever for any inaccuracy, misunderstanding or expectation drawn from the content of the Website. 

10. Vetstoria is not an adviser or counsellor and does not hold itself out as providing veterinary advice on the Website. Vetstoria shall not be responsible for any advice obtained through a person’s use, or due to their use, of the Website, or any information contained on the Website

Your use of content

11. All rights in the Website, including copyright and any other intellectual property rights such as trade marks and database rights, the content and design of the Website, the content of the videos and articles displayed on the Website and all materials (with the exception of Personal Data defined below) contained on the Website (collectively the “Vetstoria Content”), are owned by Vetstoria or used under license from third party owners. Personal Data shall be defined as any of the following: name, telephone, email and postal address (and additionally, in the case of veterinary practices, RCVS registration number and financial information), and such other personal data by which we can identify a natural person or which, taken together with other information in our possession or which may come into our possession, would allow us to identify a natural person. Unless the context clearly requires otherwise, the term Website shall include Vetstoria Content. Any use of this Website or its contents, including copying or storing it or its contents in whole or part, other than for your personal and non-commercial use is prohibited without the prior written permission of Vetstoria. You are prohibited from copying, modifying, duplicating, creating derivative works from, mirroring, republishing, downloading, transmitting, distributing, selling, displaying, altering, reverse engineering, decompiling, disassembling or otherwise licensing or reproducing any content including images and other media on this Website. By accessing the Website you acknowledge that any unauthorized use of Vetstoria Content by you may violate copyright, trademark, privacy and/or other applicable laws. You agree Vetstoria will have no responsibility or liability for any unauthorized use. 

12. You must not use the Website for junk mail, spam, pyramid or any fraudulent schemes, nor do anything that would disrupt the services of the Website, including the introduction of worms, viruses, software bombs or mass mailings. 

13. You must not deploy on the Website any bot, spider, web crawler or another automated query program at any time for any reason. We prohibit scraping, crawling, or caching of the Website. The use of automated systems or software to extract data from the Website for commercial purposes (‘screen scraping’) is prohibited. 

14. With the exception of Personal Data which shall be handled with special care in accordance with our Privacy Policy, any material you upload or submit to Vetstoria, whether directly to the Website or via email, telephone, letter or other method (collectively the “Uploads”) will be considered to be non-confidential and non-proprietary and you shall be deemed to have granted (without compensation to you) Vetstoria and Vetstoria’s affiliates, a worldwide, perpetual, non-exclusive license to use the same in any manner whatsoever for any purpose, including but not limited to promotional/marketing material for the development of products and services. 

15. You represent and warrant that (i) you own all rights in such Uploads, (ii) the Uploads are accurate, reliable and complete, (iii) the Uploads are lawful and not false or fraudulent in any way and do not infringe the intellectual property rights, privacy or other legal rights of any third party (iv) the Uploads are not harmful, such as spam or virus (v) you will not seek the return of the Uploads and (vi) you will not assert any claims against and irrevocably waive all claims to compensation from Vetstoria and its affiliates and its or its affiliates respective officers, directors, employees, contractors, agents, suppliers, service providers, licensors, third party partners and assigns in connection with the Uploads.

Your responsibilities

16. The transmission of threatening, defamatory, pornographic, political, racist, offensive, slanderous, libelous, deceptive, fraudulent or otherwise unlawful material, including the infringement of the copyright, trademark or other intellectual property rights of another, is strictly prohibited.

Termination

17. If you breach the provisions of these Terms of Use, Vetstoria may suspend or permanently terminate your access to the Website.

Your information

18. Vetstoria processes information about you in accordance with the Privacy Policy displayed on the Website from time to time.

Your responsibilities

19. You will not use the Website for any other purposes than those set out in these Terms of Use or any document or policy referred to herein. 

20. You agree to comply with any guidelines or requirements on the Website as well as any reasonable request or instructions by Vetstoria in connection with the Website which may be notified to you from time to time. 

21. You agree to notify Vetstoria immediately in writing of any inappropriate behaviour you discover in connection with the Website or as a result of using the Website so that Vetstoria can take such action as it considers appropriate in its discretion.

Disclaimer of warranties and liability

22. To the maximum extent permitted by law, Vetstoria disclaims all liability, representations, warranties, whether express or implied by statute, custom or usage relating to the information contained in or services offered on this Website. This does not affect your statutory rights under English law. Vetstoria does not limit or exclude its liability for death or personal injury caused by its negligence, or in respect of any fraudulent misrepresentation, or any other liability, which it cannot exclude by law. Vetstoria shall not be liable for any losses or damages (whether direct, indirect or consequential) whatsoever, whether in contract, tort (including negligence), or otherwise arising from this Website, or from any interruption or delay in accessing this Website. 

23. Vetstoria’s total liability to you in contract, tort (including negligence or breach of statutory duty, misrepresentation or otherwise) or for any other common law or statutory cause of action or otherwise arising by reason of or in connection with these Terms of Use shall be limited to £100.

Indemnity

24. By agreeing to these Terms of Use, you agree to fully and effectively indemnify, defend and hold harmless Vetstoria, its officers, directors, employees, contractors, agents, suppliers, service providers, licensors and third party partners from and against all third party claims, costs, losses and/or liabilities relating or arising in connection with any illegal use of the Website, any breach of your representations or warranties or any violation of the Terms of Use by you.

Entire agreement

25. These Terms of Use and any document or policies referred to herein (including but not limited to the Privacy Policy), represent the entire agreement between you and Vetstoria for the provision of the services set out on the Website and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing, in relation to the services. You acknowledge that, in entering into the contract with Vetstoria, you have not relied upon any representation, undertaking or promise by Vetstoria and that nothing is implied from anything said or written between us prior to the contract being finalised, except as expressly stated herein. You shall have no remedy in respect of any untrue statement made by Vetstoria, whether orally or in writing, prior to the date of the contract (unless such untrue statement was made fraudulently) and your only remedy shall be for breach of contract as provided in these Terms of Use.

General provisions

26. If any part of these Terms of Use or any document referred to herein is illegal, void, voidable or otherwise unenforceable, such portion(s) shall be excluded from these Terms of Use and any relevant document to the minimum extent required and the balance of these Terms of Use and any relevant document shall remain in full force and effect and enforceable. 

27. The paragraph headings used in these Terms of Use are for reference purposes only and shall not affect in any way the meaning or interpretation of these Terms of Use. 

28. If we fail, at any time during the term of your use of the Website, to insist upon strict performance of any of your obligations under these Terms of Use, or if we fail to exercise any of the rights or remedies to which we are entitled under these Terms of Use, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations. A waiver of any right under these Terms of Use is only effective if it is in writing and it applies only to the party to whom the waiver is addressed and the circumstances for which it is given. 

29. It is not the intention of the parties to confer any rights on any third parties by virtue of this Agreement and accordingly a person who is not a party to these Terms of Use shall have no right under the Contracts (Rights of Third Parties) Act 1999.

30. These Terms of Use and any dispute or claim arising out of or in connection with it or its subject matter, shall be governed by, and construed in accordance with, the law of England and Wales. Any dispute or claim that arises out of or in connection with these Terms of Use or the subject matter contained herein shall be referred to and finally resolved by arbitration under the LCIA Rules, which Rules are deemed to be incorporated by reference into this paragraph. It is hereby agreed the number of arbitrators shall be one; the seat of arbitration shall be London, England; and the language to be used in the arbitral proceedings shall be English.
